Conditions for filing a financial claim

When filing a financial lawsuit, there are a set of conditions that must be followed :

• The plaintiff shall clarify the financial right he claims, by stating the facts of the case in detail and clearly.
• The amount must be specified and also the location of the defendant must be determined.
• Provide evidence showing that the defendant is objecting to the payment of the debt, in addition to mentioning the names of witnesses to the incident.
• Appointing a specialized lawyer to follow up all legal procedures, and asking the defendant to take an oath, and this system is mentioned in the Code of Procedure in proving financial claims.
• The lawyer registers the case and sets a date to start discussing the case.
• Prepare the statement of claim and prepare it in accordance with the legal conditions, and state the details of the incident in detail.
• Submit the statement of claim to the court, with evidence, if any.
• The lawsuit is registered and given a number, and the number must be kept to complete the lawsuit procedures.
• The date of the first hearing of the consideration of the case is generally determined.
• Then the rest of the sessions are followed, as the lawsuit may take from 3 to 5 sessions or more depending on what the lawsuit requests.
• In the absence of evidence or proof of the case, the plaintiff shall bring witnesses, if any, or demand the defendant to take an oath, and the court may consider the matter and issue a verdict.
• Obligation to pay all claimed judicial fees after the end of lawsuit in case of loss.
